A Study on the Enlargement of Coverage Range in Workers¡¯ Compensation Insurance to Unpaid Family Workers

Abstract
It is attributed to using the definition of worker in the Labor Standard Law that problems associated with the coverage range of insurance group of people are continuously happening in Workers¡¯ Compensation Insurance. Unpaid family workers don¡¯t fall into the category of ¡°workers¡± under the definition of the Labor Standard Law. Judging from the fact that they are exposed to similar risks of industrial accidents as workers, they, however, need to be protected by Workers¡¯ Compensation Insurance. In addition, the study on the coverage range of insurance group of people shows that unpaid family workers can be insured at least voluntarily in Workers¡¯ Compensation Insurance in case of America, Japan, Germany and France. It turned out in the field survey that firms hiring them are mainly small-sized and they need to be protected by the Social Insurance System. Finally the system which allows employer of small firms to be insured voluntarily does not have any negative effect on the financial solidarity. This paper suggests that Workers¡¯ Compensation Insurance should cover unpaid family workers.
